Section 1: Our Services
DealSpot Philippines (henceforth to be referred to as DealSpot.ph, the website, the company, we, us, and/or it) is owned by DealSpot Philippines. We offer products and services (henceforth to be referred to as deals, bargains, discounts, offers, and/or products and services) of sellers (henceforth to be referred to as merchants, they, and/or them) to buyers (henceforth to be referred to as users, subscribers, visitors, buyers, they, and/or them) through our website at discounted prices. Merchants provide us with their products and/or services. These are offered on our website at discounted prices to a selected number of buyers who are willing to buy them within a selected time period. When the selected quota of buyers needed to activate a deal is met, we collect payment from the buyers on behalf of the merchant. Once payment is confirmed, buyers are provided coupons through our website which will enable them to redeem the product/service they bought.
Section 2: Terms and Conditions Applicable Only to Buyers
2.1. The deals we promote on our website will be offered with certain and specific limitations. Therefore, we expect all our buyers to read all the terms and conditions relevant to the deals they wish to participate in. For example, most of the deals are not available to individuals residing outside the Philippines. Similarly, our deals are often subject to time limits and other restrictions which require buyers to complete transactions within a certain time frame and/or in a certain manner to be able to redeem the products and/ or services they bought. We will use reasonable efforts to make any limitations known to our buyers when we promote deals.
2.2. Each buyer is given opportunity to buy limited number of e-voucher per deal. Each e-voucher can be used according to buyer's preference, either used in one visit or in multiple visits to the establishment, provided it is within the specified period and terms. All DealSpot Philippines evoucher/s are not redeemable in partial amounts; buyers who purchase coupons for the purpose of reselling them will have their accounts frozen and will be banned from participating in any DealSpot Philippines deal and/or any other similar promotion; neither DealSpot Philippines nor any of our business partners and merchants who avail of our services can be responsible or liable if a buyer's coupon is lost or stolen.
2.3. To redeem the product or service bought in a deal, the buyer will have to purchase an e-voucher through the website. The buyer will be required to provide the full name of the person who will use it: whether that person will be the buyer himself/herself or someone else to whom the buyer plans to transfer the e-voucher. An endorsement letter coming for the person provided in the list is needed when the e-voucher is given to another person not included in the list. The name the buyer provides will only be shared with the merchant listed on it.
2.4. Unless specifically stated otherwise in a deal and on a DealSpot Philippines coupon, a charge for a coupon does not include sales tax and any other similar add-ons.
2.5. If a buyer has problems with his or her e-voucher or the products and/or services he or she redeemed, DealSpot Philippines cannot and will not guarantee the buyers any issuance of refunds or credits. Since both companies serve only as an intermediary and agent of merchants, they will only use reasonable efforts to assist buyers in dealing with them at the event of a problem with their coupons and in redeeming their products and/services.
2.6. DealSpot Philippines is the only entity with the discretion to determine a buyer's compliance with these terms and conditions. Hence, both companies reserve their rights to restrict, suspend, deny, or terminate the access of any buyer to any part of the website, with or without notice of any kind.
2.7. Any buyer who violates any of the terms or conditions stated here won't be allowed to redeem any product and/or service and will not be refunded for the charge of his or her coupon.
2.8. If you are under the age of 18 and you wish to avail of our services, please ask your parent's permission first before you do. All our services are subject to similar and further age limitations
2.9. DealSpot Philippines does not knowingly collect any information from persons under the age of 18. When we determine that content of any kind has been uploaded to our website by someone under the age of 18, it will be removed with or withot notice of any kind.
2.10 For those buyers who will purchase our deals using their credit card, they shall comply with our Security Check. This is done to avoid fraud credit card holders. Once the process has been verified, buyers will no longer have to undergo this process.
2.11 Buyers/subcribers who failed to pay his/her purchased deal three times will have his/her account suspended by the system to eliminate bogus buyers in the website. However, the suspension of the account of the said buyer or subscriber will only be lifted upon his/her coordination with Sales Department of DealSpot Philippines.
Section 3: Terms and Conditions Applicable Only to Merchants
3.1. When they avail of our services, merchants hereby appoints DealSpot Philippines as its limited intermediary and agent, solely for the purposes of: promoting their products and/or services for a period agreed to and signed by both the merchant and DealSpot Philippines; collecting payment from buyers through their credit cards on behalf of merchants when the estimate aggregate number of buyers agreed to and signed by both the merchant and DealSpot Philippines in order to activate a deal has been reached; and for issuing coupons to buyers needed to redeem the products and/or services they bought from the merchants through the website.
3.2. Merchants must agree that DealSpot Philippines may use their identifying name, brand information, and photographs of their business operations and merchandise for all media and/or publicity purposes, in connection with promoting their products and/or services on our website. DealSpot Philippines will reasonably comply with any trademark guidelines provided by the merchants when we request for any or all of the aforementioned materials.
3.3. Merchants must represent and warrant that they: will honor all the terms and conditions of all deals made in their behalf in a professional manner; they will not impose any term or condition which is in violation of our terms and conditions or is against any law; they will have and grant sufficient intellectual property rights for any material which they will provide DealSpot Philippines with for our use when they avail of our services; and they shall collect and use personal information from buyers only in accordance with the law, our terms and conditions, and the terms and conditions of our privacy policy.
3.4. DealSpot Philippines reserves their right to restrict merchants from setting expiration dates or charge fees against those stated in our deals and on our coupons.
3.5. Both merchants and DealSpot Philippines will pay one another of the fees agreed to and signed by both when the merchant avails of any of DealSpot Philippines' services.
3.6. With the sole exception of taxes on DealSpot Philippines' net income, merchants are responsible for collecting from buyers and paying any and all taxes and fees, including but not limited to sales, use, gross income and value added taxes associated with the fulfillment of deals made through our website.
3.7. Once they avail of our services, merchants must therefore acknowledge, understand and agree that the availability of our services shall be on a first-come, first-serve basis. DealSpot Philippines, under any circumstance, cannot be held responsible or liable to any merchant for the unavailability of our website to them. Merchants must further acknowledge, understand, and agree that DealSpot Philippines is under no obligation to continue promoting their products and/or services on our website after the promotional period which has been agreed to and signed by both the merchant and DealSpot Philippines ends.
Section 4: User Information and Account Security
4.1. In order to access our website and avail of our services, buyers are required to provide us with their personal information (i.e. personal identification, contact information, etc.) as both part of the registration process and their continued use of our website and our services. Once you register to our website, we therefore assume that you acknowledge, understand, and agree that the information you have given to us is accurate, correct, and up-to-date. For information regarding our collection and use of your personal information, please refer to our privacy policy.
4.2. Once you register to our website, we therefore assume that you acknowledge, understand, and agree that you are responsible for maintaining the confidentiality of the passwords to your DealSpot Philippines account. We further assume that you will be solely responsible for all the activities of any user who logged in to our website using your account credentials. Kindly inform us via email when you have determined any unauthorized use of your account so we may deal with it accordingly.
